These Terms and Conditions govern your use of the service available to registered Employers (the “Service”) through our Website at www.jobtimise.co.uk (the “Website”). They should be read in conjunction with our general Terms of Use and Privacy Policy which shall also apply to your use of this Website. Please read these Terms and Conditions carefully before registering. By registering you are forming a contract and agreeing to be bound by the Terms and Conditions below. If you do not agree to these Terms and Conditions, please do not register to use this Website.

2. Registration

To register as an Employer you should visit http://www.jobtimise.co.uk/page/jobemployer/register.cfm . You will be asked to provide certain information about your business or organisation. You must ensure that the information provided by you on registration or at any time thereafter is correct, complete and not misleading.

You must inform us immediately of any changes to the information that you provided when registering by updating your details in order that we may communicate with you effectively.

By registering you are forming a contract with us. The contract between us will consist of your registration details and these Terms and Conditions. Any orders for Job Packs submitted by you under clause 5 and accepted by us will also form part of the contract between us. Reference to these Terms and Conditions includes our Terms of Use and Privacy Policy.

We will not file the concluded contract between us online and you should therefore print out and retain each element the contract. We can only conclude this contract with you and provide the Service to you in English and not in any other language.

3. Provision of the Service

Following registration, and in consideration of you agreeing to these Terms and Conditions, we will make the Service available to you. Reference to these Terms and Conditions includes our Terms of Use and Privacy Policy.

The Service shall be as described on the Website from time to time. We are continually seeking to improve the Service. We reserve the right, at our absolute discretion, to make changes to any part of the Service without notice.

4. Passwords and Security

On registration you will be asked to select a username and password (“ID”). You may choose to authorise your employees (“Users”) to use your ID whilst carrying out the business of your organisation. You are responsible for use of the Service by all such Users and anyone else using your ID and for preventing unauthorised use of your ID. You must ensure that your Users comply with these Terms and Conditions any other user terms appearing on the Website.

If you believe there has been a breach of security such as the disclosure, theft or unauthorised use of your ID, you must notify us immediately by emailing info@jobtimise.co.uk .

If we reasonably believe that your ID is being used in any way which is not permitted by these Terms and Conditions, we reserve the right to suspend access rights immediately on giving notice to you and to block access from your ID until the issues has been resolved.

5. Purchase of Job Packs

The Service allows Employers to purchase advertising space and related services (“Job Packs”).

Information about the Job Packs available to you, including the price and any applicable VAT, will be posted on the Website from time to time. The information about the Job Packs on our Website constitutes an “invitation to treat” and is not a contractual offer from us, which you may accept. This means we reserve the right to correct any errors in that information without contractual liability to you, even if those errors are repeated in your order.

To order a Job Pack you should select the Job Pack you wish to purchase and click on the “buy” button. You will then be shown a copy of your order and asked to confirm your payment details. It is your responsibility to check the details of your order carefully and to identify any errors before submitting your order. The Website allows you to cancel your order at any time up to the point that you confirm that you wish to proceed to payment.

6. Price and Payment

You may make payment online by credit or debit card. If you are making payment online, following confirmation of your order, you will be transferred to our secure payment provider to conclude your payment.

You may also apply to open a credit account with us by contacting info@jobtimise.co.uk . Credit facilities are offered and may be withdrawn at our absolute discretion. If you have an active credit account with us, following confirmation of your order, we will post you a paper invoice. All invoices must be paid within 14 days of the date of the invoice. If you fail to pay any invoice by the due date, we reserve the right to charge interest under the Late Payment of Commercial Debts (Interest) Act 1998 and subsidiary legislation as amended from time to time together with compensation for debt recovery costs.

7. Order Confirmation

Your order is an offer to purchase services (as described in the relevant Job Pack) from us. The services will be made available once your payment has been authorised and we have accepted your order by email. We will not be obliged to supply those services to you until your payment has been authorised and we have accepted your order. At any point up until then, we may decline to supply the services to you without giving any reason. We will confirm authorisation of your payment and acceptance of your order by email without undue delay, following which the Job Pack will be credited to your user account.

8. Submission of Material and Content

The Service allows you to create, edit and submit material for inclusion on the Website, including (without limitation) your company profile, logo, and job advertisements (“Material”). Whilst we do not seek to monitor or control the submission of Material, we do reserve the right to delete, move and edit any material submitted where in our absolute discretion we consider it prudent or necessary to do so.

You agree to comply with all applicable laws and regulations when using the Service and our Website. You are solely responsible for all Material you submit for inclusion on the Website. You are prohibited from posting to or from our Website any Material that:

  • is fraudulent or misleading;
  • is unlawful, harassing, libellous, abusive, threatening, harmful, vulgar, obscene, or otherwise objectionable or breaches any laws;
  • encourages conduct that constitutes a criminal offence, gives rise to civil liability or otherwise breaches any applicable laws, regulations or code of practice;
  • infringes the copyright or other rights of any third party;
  • is technically harmful (including, without limitation, computer viruses or other malicious software or harmful data).

9. Licence to Use Material

By submitting Material to the Website you are granting us a royalty-free, non-exclusive licence to use, reproduce, modify, translate, make available and distribute the Material on or through the Website for the purpose of providing the Service and promoting the Website to prospective Jobseekers.

10. Third Party Material

The Service allows you to receive and have access to material submitted by others including (without limitation) job applications and information supplied by Jobseekers (“Third Party Material”). We have asked all users to use this Website responsibly but cannot guarantee the accuracy, integrity or quality of any Third Party Material. We do not endorse, check or verify any Third Party Material published or transmitted via this Website.

You shall be solely responsible for checking and verifying any Third Party Material which you access via or receive via this Website before placing any reliance on it.

You shall be responsible for complying with all applicable laws and regulations in your use of Third Party Material and dealings with Jobseekers (including without limitation all applicable employment and data protection legislation).

11. Indemnity

You agree to indemnify and hold us harmless against any and losses or costs which result from your breach of these Terms and Conditions.

12. Warranty

We warrant that that we will use all reasonable skill and care in making the Service available to you and ensuring its availability during the period of your registration.

Whilst we endeavour to ensure that the information available on or through the Website is correct, up to date and accurate we do not warrant the accuracy and completeness of such material. In particular (but without limitation), this Website permits you to access and receive information supplied by third parties. The third parties submitting this information are responsible for ensuring that material submitted is accurate and complies with relevant laws and codes. We will not be responsible to you for the conduct of any such third party or for any error or inaccuracy in any material they supply.

Although we aim to offer you the best service possible, we make no promise that the Service at the Website will meet your requirements. We cannot guarantee that the Service will be fault or virus free or continuously available. Your access to the Website may be occasionally restricted to allow for repairs, maintenance or the introduction of new facilities or services. We will attempt to restore the Service as soon as we reasonably can.

The Website should not be relied upon as a storage devise for data or information. You should retain copies of all Material and information you submit via this Website for your own records.

Save as expressly set out in this agreement all conditions, warranties or other terms which might have effect between the parties or be implied or incorporated into the contract between the parties or any collateral contract, whether by statute, common law or otherwise, are hereby excluded to the fullest extent permitted by law.

13. Liability

We will use our reasonable endeavours to remedy faults in the Service.

If we are in breach of these Terms and Conditions, you agree that your only recovery for damages that you incur, and your exclusive remedy, shall be limited to an amount equivalent to the price paid by you for any Job Packs in the 12 months preceding notification to us of your claim.

We will not be liable for any business losses such as loss of reputation, lost data, lost profits or business interruption arising from your (or your Users) use or inability to use the Service or for action take (or refrained from being taken) as a result of you using the Service.

Nothing in these terms of use shall exclude or limit our liability for death or personal injury due to our negligence or for fraudulent misrepresentation or for any other liability which can not be excluded or limited under applicable law.

14. Termination

We may suspend or cancel your registration and terminate your access to the Service immediately if you fail to pay any sum due to us by the due date, are in material breach of these Terms and Conditions or (in our reasonable opinion) have made improper use of the Service or this Website.

You may cancel your registration without receiving a refund at any time by contacting info@jobtimise.co.uk . You may cancel your registration and receive a pro-rata refund in relation to any unexpired Job Packs you have purchased if we are in material breach of these Terms and Conditions or if we discontinue the Service for any reason.

The suspension, cancellation or termination of your registration and your right to use the Service shall not affect either party’s statutory right or liabilities.

15. Notices

All notices shall be given to us via email to info@jobtimise.co.uk or by post to our registered office; or to you at either the email or postal address you provide during registration.

Notice will be deemed received when an email is received (or else on the next business day if it is received on a weekend or a public holiday in the place of receipt) or 3 days after the date of posting.

16. General

If any provision of these Terms and Conditions is held by any court of competent authority to be void or unenforceable in whole or in part, the other provisions of these Terms and Conditions and the remainder of the affected provisions shall continue to be valid.

The failure to exercise a right or remedy provided by these Terms and Conditions or by the law does not constitute a waiver of other rights or remedies.

17. Applicable Law

These Terms and Conditions will be subject to the laws of England and Wales and the English courts shall have jurisdiction to resolve any disputes between us.
